Many family matters — including divorce, financial settlements, and child arrangements — can be resolved through negotiation or mediation without the need for court proceedings. This approach is almost always quicker, less costly, and less stressful than contested litigation. Frequently asked questions
How long does a divorce take?
Under the current no-fault divorce law, the minimum timeframe is approximately 26 weeks (around six months) from the date of application. This includes a 20-week reflection period before a conditional order can be made, and a further six-week wait before the final divorce order. Financial and child arrangements may take longer if they are disputed. We will give you a realistic timeline based on your specific circumstances at your first consultation.
What happens to the family home on divorce?
The family home is usually the largest matrimonial asset and there is no automatic rule that determines what happens to it. The court has broad discretion and will consider factors including the needs of any children, each party's financial situation, contributions made during the marriage, and future housing needs. Options include one party buying out the other, a deferred sale (often until children reach a certain age), or an immediate sale and division of proceeds. We will advise you on what outcome is realistic given your circumstances.
Can I get legal aid for family law matters?
Legal aid for family law matters is now very limited and is generally only available in cases involving domestic abuse or child abduction, subject to a means and merits test. For most family matters, legal aid is not available. We offer clear, transparent fee arrangements and will discuss costs with you openly at the outset so you can make an informed decision. We aim to resolve matters as efficiently as possible to keep costs proportionate.
What is a non-molestation order and how quickly can I get one?
A non-molestation order is a court order that prohibits your partner or ex-partner from using or threatening violence against you, harassing or intimidating you, or communicating with you in a way that causes distress. In urgent cases, we can apply for an emergency without-notice order — meaning the other party is not informed in advance — and a hearing can take place within 24 to 48 hours. Breaching a non-molestation order is a criminal offence. If you need urgent protection, please contact us immediately.
How are child arrangements decided if parents cannot agree?
If parents cannot reach agreement on their own or through mediation, either party can apply to the family court for a Child Arrangements Order. The court's primary consideration is always the welfare of the child. It will consider the child's wishes (depending on age and understanding), their physical and emotional needs, the likely effect of any change in circumstances, and any risk of harm. We always encourage agreement where possible as it is better for children, but we are fully prepared to represent you in court if agreement cannot be reached.
