Specialist representation in child arrangements disputes, from first advice through to final order.
A child arrangements order is a court order under section 8 of the Children Act 1989 that determines where a child lives and when they spend time with each parent. The court's paramount consideration is the welfare of the child, assessed against the statutory welfare checklist, which includes the child's ascertainable wishes and feelings, their physical and emotional needs, the likely effect of any change, and any risk of harm.
Cafcass (the Children and Family Court Advisory and Support Service) plays an important role in child arrangements proceedings. A Cafcass officer will prepare a safeguarding letter after initial checks and, where the case is more complex, may be asked by the court to prepare a section 7 welfare report with a recommendation. We work closely with Cafcass throughout proceedings and advise you on how to engage with the process constructively. For cases involving significant safeguarding concerns, proceedings may overlap with our care proceedings service. Our full family law team is available throughout.

How child arrangements proceedings work
Understanding what to expect at each stage helps reduce anxiety and allows you to focus on what matters — your children.
Letter of Instruction to Cafcass
On issue of a child arrangements application, the court notifies Cafcass, who prepare a safeguarding letter within 17 days based on police and social care checks.
MIAM / Mediation
Before making an application, you must attend a Mediation Information and Assessment Meeting (MIAM) unless an exemption applies. We advise on whether mediation is suitable.
First Hearing Dispute Resolution
The First Hearing Dispute Resolution Appointment (FHDRA) is usually listed within 4–6 weeks of issue. The court attempts to narrow issues and, where possible, reach agreement.
Final Hearing
If agreement cannot be reached, the court lists a final hearing at which both parties give evidence and the judge makes an order. We prepare and present your case fully.
