How housing disrepair compensation is calculated
Housing disrepair compensation consists of two elements: general damages (a percentage reduction in rental value for the period of disrepair) and special damages (your actual financial losses). Understanding both is key to knowing what your claim is worth.
General damages compensate you for the inconvenience, discomfort and loss of enjoyment of your home caused by the disrepair. They are calculated as a percentage reduction in the rental value of your property for the period the disrepair has persisted. The percentage depends on the severity and extent of the disrepair. Minor issues affecting a small part of the property — a dripping tap or a small patch of damp — might attract a 10 to 25 per cent reduction. Significant disrepair such as widespread damp and mould affecting multiple rooms, or a broken heating system during winter, typically warrants a 33 to 50 per cent reduction. Where the property is near uninhabitable — severe structural defects, no heating and hot water, extensive mould throughout — the reduction can reach 50 to 100 per cent. The duration of the disrepair is critical: a landlord who repairs quickly after notification will pay much less than one who ignores complaints for months or years.
Special damages cover your actual financial losses resulting from the disrepair. This includes the cost of replacing belongings damaged by damp, mould, water leaks or pest infestation — furniture, carpets, electronics, clothing, bedding and personal items, all valued at their current replacement cost. Special damages also include medical costs and prescription charges where the disrepair has caused health problems, the cost of temporary heating equipment and increased energy bills where the heating has failed, and the cost of alternative accommodation where the property became uninhabitable. Receipts and evidence are important for special damages, but where receipts are unavailable, reasonable estimates supported by market prices are accepted. How is the rent reduction percentage calculated?
The rent reduction is based on the severity of the disrepair and the proportion of the property affected. A court considers factors including which rooms are affected, the nature and extent of the disrepair, the health risk, and the impact on your daily life. A single small damp patch in a hallway might attract 10 per cent, while widespread mould throughout the bedrooms and living areas might attract 40 to 50 per cent. The reduction is applied to the full rental value — including housing benefit or Universal Credit housing element — for the entire period of disrepair. Abraham Baron Solicitors calculate this precisely for every claim.
Can I claim for damaged belongings?
Yes. Belongings damaged by disrepair — furniture ruined by damp, electronics damaged by water leaks, clothing destroyed by mould, mattresses infested with bed bugs — are claimed as special damages at their current replacement cost. You do not need original receipts for every item, but you should keep a detailed list with descriptions and approximate values. Photographs of damaged items are valuable evidence. Abraham Baron Solicitors prepare a comprehensive schedule of damaged belongings for every claim and can advise on reasonable replacement values.
Does the duration of disrepair affect compensation?
Yes — duration is one of the most important factors. General damages are calculated as the rent reduction percentage multiplied by the number of months the disrepair persisted. A 40 per cent reduction over 12 months on a property renting at 800 pounds per month equals 3,840 pounds in general damages alone. This is why it is important to report disrepair in writing as early as possible — the compensation period runs from when the landlord was notified (or should reasonably have been aware). Abraham Baron Solicitors advise you to notify your landlord immediately and keep records of all complaints.
Can I claim even if the disrepair has now been fixed?
Yes. You are entitled to compensation for the entire period you lived with the disrepair — from when the landlord was notified until repairs were completed. The fact that the landlord has now fixed the problem does not extinguish your right to compensation for the months or years you endured it. Many of the claims Abraham Baron Solicitors pursue are retrospective — the tenant lived with damp, mould or broken heating for an extended period, the landlord eventually repaired it, and the tenant then claims compensation for the affected period.
How long does a housing disrepair compensation claim take?
Most housing disrepair claims settle within 6 to 12 months. The pre-action protocol gives the landlord 20 working days to respond to the initial letter of claim. If the landlord engages constructively, settlement can be reached within a few months. If court proceedings are necessary, the process takes longer — typically 9 to 12 months from issue to trial.
