Local authority landlords — councils — are bound by the same section 11 duties under the Landlord and Tenant Act 1985 as private landlords. They must keep in repair the structure and exterior, installations for water, gas, electricity, sanitation and heating. But councils face additional obligations that private landlords do not. The Decent Homes Standard requires all social housing to meet a minimum quality threshold — it must be free from serious hazards under the Housing Health and Safety Rating System (HHSRS), be in a reasonable state of repair, have reasonably modern facilities and services, and provide a reasonable degree of thermal comfort. Awaab's Law imposes strict timescales on social landlords: investigate reported hazards within 14 days, begin repairs within 7 days if a health risk is identified, and complete emergency repairs within 24 hours. As public bodies, councils are also subject to judicial review and have obligations under the Human Rights Act 1998 — the right to respect for private and family life includes the right to a habitable home. The Homes (Fitness for Human Habitation) Act 2018 and the Defective Premises Act 1972 provide further routes to compensation.
