Damp and mould in a rented home is one of the most common housing disrepair complaints in the UK. If your landlord has failed to fix it after being notified, you have a legal right to claim compensation and force repairs.
There are three main types of damp that affect rented properties. Rising damp occurs when moisture is drawn up through walls and floors from the ground below, often leaving tide marks and salt deposits on internal walls. Penetrating damp is caused by water entering through the building fabric itself — through damaged roof tiles, failed pointing, cracked render or defective windows. Condensation damp happens when moisture from everyday activities such as cooking, bathing and drying clothes accumulates on cold surfaces, producing the black mould that is so common in poorly ventilated homes. Structural damp — rising and penetrating damp — is almost always the landlord's responsibility under section 11 of the Landlord and Tenant Act 1985, which imposes a duty to keep in repair the structure and exterior of the dwelling. Condensation damp is more nuanced, but where it results from inadequate heating, poor ventilation or insufficient insulation, the landlord is liable under the Homes (Fitness for Human Habitation) Act 2018, which requires rented properties to be fit for human habitation throughout the tenancy.
The health consequences of living with damp and mould can be severe. Prolonged exposure to mould spores causes and exacerbates respiratory conditions including asthma, bronchitis and chronic cough, triggers allergic reactions such as rhinitis and dermatitis, and can lead to serious respiratory infections — particularly in children, the elderly and those with pre-existing conditions. The tragic case of Awaab Ishak, a two-year-old who died in December 2020 from a respiratory condition caused by mould in his Rochdale housing association flat, brought national attention to the issue. In response, the government introduced Awaab's Law, which places time-specific duties on social landlords: they must investigate reported hazards within 14 days, begin repairs within 7 days if a health risk is identified, and complete emergency repairs within 24 hours. These duties give social housing tenants particularly strong grounds for action when landlords fail to address damp and mould.
Before legal proceedings can begin, tenants must follow the housing disrepair pre-action protocol. This means notifying your landlord in writing about the damp and mould and giving them a reasonable period to carry out repairs. What counts as reasonable depends on urgency — a severe mould infestation affecting a child's bedroom requires faster action than minor condensation in a hallway.
