The Electrical Safety Standards in the Private Rented Sector (England) Regulations 2020 require private landlords to have a valid Electrical Installation Condition Report (EICR) every 5 years. Failure to comply is a criminal offence.
The Electrical Safety Standards in the Private Rented Sector (England) Regulations 2020 impose specific duties on private landlords regarding electrical safety. Every private rented property must have an Electrical Installation Condition Report (EICR) carried out by a qualified electrician at least every five years, and a copy must be provided to the tenant within 28 days. The EICR examines the fixed electrical installation — wiring, consumer unit (fuse box), sockets, switches, light fittings and any permanently connected equipment. Where the EICR identifies defects requiring remedial action, the landlord must complete the necessary works within 28 days or within any shorter period specified in the report. Failure to comply with these regulations is a criminal offence, and local authorities can impose financial penalties of up to 30,000 pounds per breach. Beyond the 2020 Regulations, section 11 of the Landlord and Tenant Act 1985 requires landlords to keep in repair and proper working order the electrical installations in the property, and the Homes (Fitness for Human Habitation) Act 2018 renders a property with dangerous electrical defects unfit for habitation.
Electrical hazards in a rented property are among the most dangerous forms of housing disrepair. Faulty wiring can cause electrocution, electric shocks and house fires. Overloaded circuits, damaged sockets, exposed wiring and defective consumer units all pose life-threatening risks. Even less dramatic electrical faults — intermittent power failures, flickering lights, warm or discoloured sockets — can indicate serious underlying wiring problems that require urgent attention. Frequently asked questions
Must my landlord provide an EICR?
Yes. Since 1 April 2021, all private landlords in England must have a valid Electrical Installation Condition Report (EICR) for their rented properties. The EICR must be carried out by a qualified electrician at least every five years, and a copy provided to tenants within 28 days. If your landlord has not provided an EICR, they are in breach of the Electrical Safety Standards in the Private Rented Sector (England) Regulations 2020, which is a criminal offence punishable by fines of up to 30,000 pounds. You can report non-compliance to your local authority.
What happens if faulty wiring is discovered?
If an EICR identifies defects requiring urgent attention (classified as C1 or C2), the landlord must complete remedial works within 28 days or within any shorter period specified in the report. C1 defects indicate an immediate danger and should be addressed as an emergency. The landlord must then obtain a certificate confirming the works have been completed satisfactorily. If your landlord fails to carry out the required works, Abraham Baron Solicitors can pursue a housing disrepair claim and report the landlord to the local authority for enforcement action.
Can I claim compensation for an electrical injury?
Yes. If you have suffered an electric shock, burn or other injury caused by defective electrical installations in your rented property, you have both a housing disrepair claim and a personal injury claim against your landlord. The landlord has a duty of care to maintain safe electrical installations, and a breach of that duty causing injury gives rise to a negligence claim. Compensation covers pain and suffering, medical costs, loss of earnings, and any long-term impact on your health. What if my landlord refuses to fix electrical defects?
If your landlord refuses to carry out electrical repairs after being notified, Abraham Baron Solicitors take several steps simultaneously. We send a formal pre-action letter requiring compliance within a specified timeframe. We report the non-compliance to the local authority environmental health team, who have powers to impose financial penalties and carry out works in default. Where there is an immediate danger, we can apply to the court for an emergency injunction requiring the landlord to carry out works. You should also consider contacting the fire service if you believe there is an immediate fire risk.
Is my landlord responsible for electrical appliances they provided?
Yes. If the landlord provided electrical appliances as part of the tenancy — a cooker, washing machine, fridge or other appliance — they are responsible for ensuring those appliances are safe and in proper working order. This includes regular PAT (Portable Appliance Testing) and replacing defective appliances. However, the landlord is not responsible for appliances that you brought into the property yourself.
