Under section 11 of the Landlord and Tenant Act 1985, your landlord must keep in repair and proper working order the installations for space heating and heating water. A rented home without functional heating is not fit for habitation.
Section 11 of the Landlord and Tenant Act 1985 imposes a clear statutory duty on landlords to keep in repair and proper working order installations for space heating and heating water. This covers the boiler, radiators, pipes, thermostats, central heating controls and the hot water system. The duty is to repair and maintain — not to improve — but where a boiler is beyond economic repair, the landlord must replace it rather than leave the tenant without heating. The Homes (Fitness for Human Habitation) Act 2018 provides a broader fitness standard: a property without adequate heating is simply not fit for human habitation. For social housing tenants, Awaab's Law introduces strict timescales — loss of heating in winter constitutes an emergency requiring repair within 24 hours. These overlapping duties mean that tenants left without heating have strong legal grounds regardless of whether their landlord is private, a council or a housing association.
The health consequences of living without adequate heating are well documented and can be severe. Cold homes are linked to increased respiratory illness, cardiovascular conditions, exacerbation of arthritis and, in extreme cases, hypothermia — particularly for children, the elderly and those with pre-existing medical conditions. The World Health Organisation recommends a minimum indoor temperature of 18 degrees Celsius, and prolonged exposure to temperatures below this threshold causes measurable harm. Beyond direct health impact, a home without heating produces condensation, leading to damp and mould which create their own separate health hazards. Tenants left without heating can claim general damages for the inconvenience, discomfort and health impact, as well as special damages covering the cost of electric heaters, increased energy bills from inefficient temporary heating, and alternative accommodation costs in severe cases. Courts regularly grant injunctions compelling landlords to carry out urgent boiler repairs or replacements.

How quickly must my landlord fix a broken boiler?
There is no single statutory timeframe for private landlords, but loss of heating — particularly in winter — is treated as an urgent repair requiring action within days, not weeks. For social housing tenants, Awaab's Law classifies loss of heating as an emergency requiring repair within 24 hours. Even for private landlords, a court would consider anything more than a few days unreasonable during cold weather. Can I buy an electric heater and charge my landlord?
In principle, yes — where your landlord has failed to provide heating, you can take reasonable steps to mitigate your situation, and the cost of temporary electric heaters and increased electricity bills can be claimed as special damages. However, we recommend notifying your landlord in writing first and keeping all receipts. The costs must be reasonable — a few portable heaters for essential rooms is reasonable, but rewiring the property to install electric heating is not. Can I claim if I had no heating for only a few days?
Yes, though the compensation will reflect the short duration. Even a few days without heating in winter can constitute a breach of the landlord's duty under section 11 of the Landlord and Tenant Act 1985.
