The housing disrepair claim process explained
A housing disrepair claim follows a clear process. Understanding each step helps you protect your evidence, assert your rights, and maximise your compensation.
The first and most important step in any housing disrepair claim is to report the problem to your landlord in writing. This can be by email, letter, text message or through your landlord's online portal — the key is to have a written record. You must give your landlord a reasonable period to carry out repairs after notification. What counts as reasonable depends on urgency: a burst pipe or total loss of heating in winter requires immediate action (24 to 48 hours), while less urgent issues such as minor damp or a dripping tap may allow 14 to 28 days. If your landlord fails to act within a reasonable period, the next step is to instruct solicitors. Once instructed, Abraham Baron Solicitors send a formal pre-action letter to your landlord in accordance with the Housing Disrepair Pre-Action Protocol. This letter sets out the nature of the disrepair, the legal basis for the claim (section 11 of the Landlord and Tenant Act 1985, the Homes (Fitness for Human Habitation) Act 2018, the Defective Premises Act 1972), and gives the landlord 20 working days to respond. During this period, we arrange for an independent surveyor to inspect the property and produce a detailed report documenting the disrepair, its cause and the necessary remedial works. Where the disrepair has caused health problems, we obtain medical evidence — a GP letter or specialist report — linking the health condition to the housing conditions. We also compile a comprehensive schedule of special damages covering damaged belongings, medical costs, temporary heating costs and any other financial losses.
If the landlord engages constructively following the pre-action letter, we negotiate a settlement that includes both compensation and an undertaking to carry out repairs. Many claims settle at this stage. If the landlord fails to respond, denies liability or offers an inadequate settlement, we issue court proceedings. The court can order the landlord to pay compensation (general damages and special damages) and grant an injunction requiring them to carry out the repairs. All of this is handled on a no win, no fee basis through a Conditional Fee Agreement, meaning you pay nothing unless we recover compensation. Do I need to report the disrepair to my landlord before claiming?
Yes. The landlord must have notice of the disrepair before they can be held liable for failing to repair. Written notice is essential — email, letter, text message or an entry on the landlord's online reporting portal. Verbal complaints count as notice but are harder to prove. The compensation period runs from the date of notice (or the date the landlord should reasonably have been aware), so notifying your landlord in writing as early as possible maximises your claim. What is the pre-action protocol for housing disrepair?
The Housing Disrepair Pre-Action Protocol is a set of steps that both tenant and landlord must follow before court proceedings can be issued. The tenant's solicitor sends a formal letter of claim setting out the disrepair, the legal basis and the remedies sought. The landlord has 20 working days to respond — they can admit liability, deny it, or make proposals for repair and compensation. If the landlord fails to respond or the response is inadequate, the tenant can issue court proceedings. Following the protocol is not optional — a court can penalise a party who fails to comply with cost sanctions.
Do I need a solicitor to make a housing disrepair claim?

How long does a housing disrepair claim take?
Most claims settle within 6 to 12 months from instruction. The pre-action protocol allows 20 working days for the landlord to respond. If the landlord engages constructively, settlement can be reached within three to four months. If court proceedings are necessary, the timeline extends to 9 to 12 months from issue. Urgent cases — where there is an immediate health risk or safety hazard — can be expedited, and Abraham Baron Solicitors can apply for emergency injunctions within days where necessary.
What if my landlord tries to evict me for making a claim?
Retaliatory eviction protections under the Deregulation Act 2015 prevent landlords from evicting tenants who have made legitimate complaints about the condition of their property. If your landlord serves a section 21 notice (no-fault eviction) within six months of you making a complaint to the local authority, the notice is invalid. Even without a local authority complaint, Abraham Baron Solicitors can argue retaliatory eviction as a defence.
