A Conditional Fee Agreement (CFA) — commonly known as no win no fee — means you pay nothing unless your housing disrepair claim succeeds. This removes the financial barrier that prevents many tenants from enforcing their legal rights.
A Conditional Fee Agreement (CFA) is a legally binding agreement between you and your solicitor under which you pay nothing if your claim is unsuccessful. If your claim succeeds, the solicitor charges a success fee — a percentage of their standard fees, capped by law at a maximum of 25 per cent of the compensation awarded for general damages and past financial losses. This means you always receive the majority of your compensation. Disbursements — the costs of independent surveys, medical reports and court fees — are typically covered by After the Event (ATE) insurance, a policy taken out at the start of the case at no upfront cost to you. The ATE insurance premium is only payable if the claim succeeds and is often recoverable from the losing party. In practical terms, a no win, no fee arrangement means you face zero financial risk: nothing to pay if we lose, and a known, capped deduction if we win.
