Structural disrepair claims
When structural defects become a legal matter
Your landlord is responsible for keeping the structure and exterior of your rented property in repair. When structural defects develop and the landlord fails to act, you have a legal right to claim compensation and force repairs.
Section 11 of the Landlord and Tenant Act 1985 places a clear statutory duty on landlords to keep in repair the structure and exterior of a rented dwelling. This includes the walls, roof, foundations, floors, ceilings, windows, external doors, guttering and downpipes. Structural disrepair encompasses a wide range of defects: cracked external walls — particularly where caused by subsidence or ground movement — failed render, damaged or missing roof tiles, defective guttering that allows water to penetrate the building fabric, unsafe or deteriorating floors and ceilings, and subsidence affecting the stability of the property. It is important to understand that the landlord's obligation under section 11 is to keep the property in repair, not to improve it beyond its original condition. However, where structural defects render the property unfit for habitation, the Homes (Fitness for Human Habitation) Act 2018 provides an additional route, requiring the property to meet a minimum standard of fitness throughout the tenancy. The Defective Premises Act 1972 also imposes duties on landlords regarding premises that are dangerous due to defective maintenance.
Structural defects in a rented property are not merely inconvenient — they can be genuinely dangerous. Subsidence can compromise the structural integrity of the entire building, making it unsafe to occupy. Falling plaster, cracked ceilings and loose masonry can cause serious physical injury to tenants and their families. Structural cracks in external walls allow rainwater to penetrate, causing damp, mould and further deterioration of the building fabric. Where there is an immediate risk to the safety of occupants, Abraham Baron Solicitors can apply to the court for an emergency injunction requiring the landlord to carry out urgent repairs. Frequently asked questions
Is my landlord responsible for structural repairs?
Yes. Section 11 of the Landlord and Tenant Act 1985 imposes a non-excludable duty on landlords to keep in repair the structure and exterior of the dwelling. This covers walls, roof, foundations, floors, ceilings, windows, external doors, guttering and downpipes. The duty applies regardless of what the tenancy agreement says — a landlord cannot contract out of section 11. If a structural defect develops and you have notified your landlord, they must carry out repairs within a reasonable period or face legal action.
What if my landlord says the cracks are cosmetic?
Landlords frequently dismiss cracks as cosmetic to avoid carrying out expensive structural repairs. However, diagonal or stepped cracks in external brickwork, cracks wider than 5mm, and cracks that are actively widening are almost always signs of structural movement — not cosmetic issues. Abraham Baron Solicitors instruct independent chartered surveyors who will inspect the property, assess whether the cracking is structural, and produce an expert report. If the surveyor confirms structural movement, the landlord's attempt to dismiss the defect as cosmetic will carry no weight.
Can I withhold rent if the structure is unsafe?
We strongly advise against withholding rent, even where structural defects make the property unsafe. Withholding rent puts you in breach of your tenancy agreement and can give the landlord grounds to seek possession — evicting you for rent arrears. A safer alternative is to continue paying rent but to instruct solicitors to pursue the claim. In some cases, tenants may pay rent into a separate designated account to demonstrate willingness to pay while the dispute is resolved. What evidence do I need for a structural defects claim?
The most important evidence is written notification to your landlord — emails, letters or text messages reporting the structural defects and requesting repairs. Photographs and video recordings of the defects, taken regularly over time to show deterioration, are extremely valuable. An independent surveyor's report is usually essential for structural claims and Abraham Baron Solicitors arrange this as part of your case. You should also keep records of any damage to your belongings, disruption to your daily life, and correspondence with the landlord or their agents.
How long does my landlord have to fix a structural defect?
A reasonable period depends on the nature and severity of the defect. Minor structural repairs such as repointing or replacing roof tiles should be completed within 28 days of notification. More significant works — underpinning, major roof repairs, replacing structural timbers — may reasonably take longer to arrange, but the landlord must demonstrate they are taking active steps. Where there is an immediate risk to safety, such as a ceiling at risk of collapse or severe subsidence, the landlord must act immediately.
