Claiming asylum in the UK
The right to seek asylum is enshrined in the 1951 Refugee Convention. If you are in the UK and fear persecution in your home country, you have the right to claim asylum regardless of how you arrived.
Under the 1951 Refugee Convention, a refugee is a person who has a well-founded fear of persecution in their home country on one of five grounds: race, religion, nationality, political opinion, or membership of a particular social group. The asylum process in the UK begins with an initial screening interview, typically conducted shortly after you claim asylum, followed by a substantive asylum interview — the most important stage of the process — where you provide a detailed account of why you fear return. The Home Office then makes a decision on your claim. The standard of proof for asylum is lower than in civil cases: you need only show a reasonable likelihood of persecution, not prove it on the balance of probabilities. Where refugee status is not established but removal would breach Article 3 of the European Convention on Human Rights (the prohibition on torture, inhuman or degrading treatment), humanitarian protection may be granted instead. Asylum seekers who are destitute — without adequate accommodation or the means to support themselves — are entitled to support from the National Asylum Support Service (NASS), which provides housing (typically on a no-choice basis in dispersal accommodation) and a weekly financial allowance. The right to work while an asylum claim is pending is restricted: asylum seekers can apply for permission to work only if they have been waiting more than 12 months for an initial decision on their claim (and the delay is not their fault), and permission is limited to jobs on the Shortage Occupation List. If your asylum claim is refused, you have an in-country right of appeal to the First-tier Tribunal (Immigration and Asylum Chamber), meaning you can remain in the UK while your appeal is heard. What is the difference between asylum and refugee status?
Asylum is the process of applying for protection. Refugee status is the outcome — the recognition that you meet the definition of a refugee under the 1951 Refugee Convention. When you claim asylum, the Home Office assesses whether you have a well-founded fear of persecution in your home country on one of the five Convention grounds. If your claim succeeds, you are granted refugee status with 5 years’ leave to remain, the right to work, and access to public funds. What happens if my asylum claim is refused?
If your asylum claim is refused, you will normally have an in-country right of appeal to the First-tier Tribunal (Immigration and Asylum Chamber). This means you can remain in the UK while your appeal is heard. The appeal is a full rehearing of your claim before an independent immigration judge. New evidence can be submitted, and you may be called to give oral evidence. The appeal success rate for asylum claims at the tribunal is significant — many claims that the Home Office refuses are subsequently allowed on appeal. Can I work while my asylum claim is being decided?
Asylum seekers cannot generally work in the UK. However, if you have been waiting more than 12 months for an initial decision on your asylum claim (and the delay is not your fault), you can apply for permission to work. Permission is restricted to jobs on the Shortage Occupation List. In practice, the 12-month waiting period means most asylum seekers are unable to work for a significant period. How long does an asylum claim take?
The Home Office aims to make initial decisions on asylum claims within 6 months, but in practice many claims take significantly longer. Can my family join me in the UK if I am granted asylum?
Yes. Applications are made at the nearest British Embassy or High Commission.
