The UK is one of the only countries in Europe with no statutory time limit on immigration detention. Individuals can be held in Immigration Removal Centres for months while the Home Office processes their case.
The Home Office has the power to detain individuals for immigration purposes, including those pending removal from the UK and those pending a decision on their immigration status. Detention is carried out in Immigration Removal Centres (IRCs) across the country, including Brook House and Tinsley House near Gatwick, Colnbrook and Harmondsworth near Heathrow, Yarl's Wood in Bedfordshire, and Morton Hall in Lincolnshire. The legal basis for immigration detention is governed by the Hardial Singh principles established by the courts: detention can only be for the purpose of deportation or removal, it must be for a reasonable period, the Home Office must be actively pursuing removal, and a person must not be detained if there is no realistic prospect of removal within a reasonable time. Where any of these principles are breached, detention becomes unlawful and can be challenged.
Immigration bail hearings before the First-tier Tribunal can be listed within 24 to 48 hours in urgent cases, providing a fast route to release. Bail conditions typically include a residence condition, reporting to a police station or immigration office, electronic monitoring, and in some cases a financial condition (surety). Detention can also be challenged through habeas corpus applications or judicial review where it is unlawful. Within Immigration Removal Centres, Rule 35 reports play a critical role — medical practitioners must report if a detained person may be a victim of torture, has suicidal intentions, or has a condition that may be worsened by continued detention. Vulnerable individuals — including those with mental health conditions, victims of torture or trafficking, pregnant women, and children — should not be detained other than in very exceptional circumstances under the Home Office's Adults at Risk policy. How quickly can you act if someone is detained?

What is an immigration bail hearing?
An immigration bail hearing takes place before an immigration judge at the First-tier Tribunal. The judge considers whether there are reasons to grant bail — including the length of detention, the likelihood of removal, any vulnerability, and the availability of suitable bail conditions (address, surety, reporting). The Home Office will argue for continued detention, and your solicitor or barrister will present the case for release. If bail is granted, conditions will be attached — typically a residence condition, reporting to a police station or immigration office, and possibly electronic monitoring. Can I challenge detention if the Home Office says removal is imminent?
Yes — the claim that removal is imminent is one the Home Office makes frequently but does not always support with evidence. Under the Hardial Singh principles, the Home Office must demonstrate that removal can be effected within a reasonable period, not simply that it is being pursued. If travel documents have not been obtained, if there are outstanding legal challenges to removal, or if the country of destination will not accept returns, removal may not in fact be imminent regardless of what the Home Office claims. What are the conditions typically attached to immigration bail?
Immigration bail conditions are set by the judge or the Secretary of State and are designed to ensure the person remains in contact with the authorities and does not abscond. Standard conditions include a residence condition (living at a specified address), a reporting condition (reporting to a police station or immigration office at regular intervals), and a condition not to work unless permission is granted. Electronic monitoring (GPS tag) may also be imposed. A financial condition (surety) may be required, where a person deposits money that is forfeited if the bailed individual fails to comply with conditions.
