EU Settlement Scheme — ongoing issues
The EU Settlement Scheme was established to protect the rights of EU, EEA and Swiss citizens living in the UK following Brexit. While the main application deadline passed on 30 June 2021, significant numbers of applications remain outstanding and new issues continue to arise.
The EU Settlement Scheme was created to allow EU, EEA and Swiss citizens — and their family members — who were resident in the UK before 31 December 2020 to secure their immigration status after Brexit. Applicants with less than five years' continuous residence were granted pre-settled status (limited leave to remain), while those with five or more years were granted settled status (indefinite leave to remain). The distinction is critically important because pre-settled status expires after five years from the date it was granted and must be converted to settled status before it lapses. If an individual fails to convert in time, they lose their right to remain in the UK. A significant number of children were also not included in their parents' original applications or were born after applications were submitted, leaving them without status despite having a right to it.
Although the main application deadline passed on 30 June 2021, late applications can still be made where there are reasonable grounds for the delay. The Home Office has accepted a range of reasons including the applicant being unaware of the requirement, a child whose parent did not apply on their behalf, victims of domestic abuse, serious illness, and those lacking mental capacity. Family members of EU citizens with settled or pre-settled status can still join them through the EUSS family permit route. Where an EUSS application is refused, the decision can be challenged through administrative review — a free, paper-based process with a 28-day deadline. Frequently asked questions
Can I still apply to the EU Settlement Scheme after the deadline?
Yes — late applications to the EU Settlement Scheme can still be made where there are reasonable grounds for the delay. The Home Office has published guidance on what constitutes reasonable grounds, including being unaware of the requirement to apply, being a child whose parent did not apply, serious illness, mental health conditions, domestic abuse, and being in a vulnerable situation. Abraham Baron Solicitors prepare late EUSS applications with comprehensive evidence of reasonable grounds, achieving a high success rate in these cases.
What is the difference between pre-settled and settled status?
Pre-settled status (limited leave to remain) was granted to EU citizens who had less than 5 years continuous residence in the UK at the time of their application. It is valid for 5 years from the date it was granted. Settled status (indefinite leave to remain) was granted to those with 5 or more years continuous residence. The critical difference is that pre-settled status expires and must be converted to settled status before expiry, or the individual loses their right to remain in the UK. Abraham Baron Solicitors advise on the conversion process and ensure applications are made in good time.
My EUSS application was refused — what can I do?
EUSS refusals can be challenged through administrative review, which is free of charge and must be requested within 28 days of the decision. The review is conducted by a different caseworker who reassesses the application. If the administrative review is unsuccessful, you may have a right of appeal to the First-tier Tribunal on human rights grounds. Abraham Baron Solicitors analyse your refusal, advise on the strongest grounds for challenge, and prepare the administrative review or appeal on your behalf.
Can my non-EU family member apply under the EUSS?
Non-EU family members of EU citizens with settled or pre-settled status can apply for an EUSS family permit to join them in the UK. Eligible family members include spouses, civil partners, direct descendants under 21 (or dependent), dependent parents, and in some cases extended family members. The family permit is granted for 6 months, during which the family member must apply for settled or pre-settled status under the EUSS.
