Applying for Indefinite Leave to Remain
Indefinite Leave to Remain is the most significant immigration milestone before British citizenship. It gives you permanent residence rights in the UK with no time limit on your stay, the right to work without restriction, and access to public funds.
The qualifying period for ILR depends on the visa route you hold. For most routes — including Skilled Worker, Spouse and Partner, and Family visas — the qualifying period is five years of continuous lawful residence in the UK. For those relying on the long residence route, the qualifying period is ten years. The continuous residence requirement is critically important: you must not have been absent from the UK for more than 180 days in any rolling 12-month period during the qualifying period. Getting this calculation wrong is one of the most common reasons for ILR refusal, and the consequences are devastating after years of building a life in the UK. Frequently asked questions
How long do I need to have lived in the UK before applying for ILR?
The qualifying period depends on the visa route you hold. For Skilled Worker visa holders, the qualifying period is 5 years of continuous lawful residence. For spouse and partner visa holders, it is also 5 years (two periods of 2.5 years). For those relying on long residence, the qualifying period is 10 years. Some routes have shorter qualifying periods — for example, bereaved partners may qualify after a shorter period. Abraham Baron Solicitors will assess your specific immigration history and confirm when you become eligible to apply.
What counts as continuous residence for ILR?
Continuous residence means that you must not have been absent from the UK for more than 180 days in any rolling 12-month period during the qualifying period. Each absence is counted, and even short trips abroad add up. There are limited exceptions — for example, absences due to serious illness of yourself or a close family member, or absences required by your employer as part of your job. Abraham Baron Solicitors calculate your absence history carefully before submitting an ILR application to ensure the continuous residence requirement is met.
What is the Life in the UK test?
The Life in the UK test is a computer-based test of 24 questions covering British history, values, traditions and government. You must answer at least 18 questions correctly (75%) to pass. The questions are based on the official handbook "Life in the United Kingdom: A Journey to Citizenship". You can take the test at approved test centres around the UK. There is no limit on the number of attempts but each attempt costs £50. Abraham Baron Solicitors advise on test preparation and timing the test in relation to your ILR application.
What is the English language requirement for ILR?
For ILR applications, you must demonstrate English language ability at B1 level on the Common European Framework of Reference (CEFR). This can be demonstrated through an approved test provider (such as IELTS Life Skills or Trinity College London), a degree taught in English (from an institution recognised by UK NARIC), or nationality of a majority English-speaking country. Those aged 65 or over and those with a long-term physical or mental condition that prevents them from meeting the requirement may be exempt. Can I apply for ILR if I have a criminal conviction?
A criminal conviction does not automatically disqualify you from ILR but it is assessed as part of the good character requirement. The Home Office considers the nature and severity of the offence, the sentence imposed, the time elapsed since the conviction, and your conduct since. Sentences of 12 months or more imprisonment normally result in refusal. Shorter sentences and non-custodial convictions are assessed on a case-by-case basis. What happens after I get ILR?
ILR gives you the right to live and work in the UK permanently with no immigration restrictions. You can access public funds and services on the same basis as British citizens. After 12 months with ILR (or 3 years of residence for spouses of British citizens), you can apply for British citizenship through naturalisation. It is important to note that ILR can be lost if you are absent from the UK for more than 2 continuous years — in which case you would need to apply for a returning resident visa.
