Your visa has been refused — what are your options?
A visa refusal can feel like the end of the road, but it often is not. Depending on the type of visa refused, you may have the right to appeal, to request an administrative review, or to reapply with stronger evidence.
The first and most important thing to understand after a visa refusal is whether you have a right of appeal. Not all refusals carry appeal rights. Human rights claims — typically those involving Article 8 of the European Convention on Human Rights (the right to private and family life) — always carry a right of appeal to the First-tier Tribunal (Immigration and Asylum Chamber). Protection claims (asylum and humanitarian protection) also carry appeal rights. EEA and EU Settlement Scheme (EUSS) decisions carry appeal rights. Family route refusals typically carry appeal rights where they engage human rights. However, work visa, student visa and visit visa refusals do not carry a right of appeal — the only challenge route available is administrative review, a paper-based reconsideration by a different Home Office caseworker. Administrative review must be requested within 14 days for in-country decisions or 28 days for out-of-country decisions, and the grounds are limited to case working errors — situations where the original caseworker overlooked evidence, misapplied a rule, or made a factual error. The success rate for administrative reviews without legal assistance is relatively low, but a focused application identifying specific errors can be effective. Where you do have a right of appeal, the First-tier Tribunal provides a full oral hearing before an independent immigration judge. This is a significant opportunity — the judge considers all the evidence afresh, including new evidence that was not available at the time of the original decision. In family visa appeals, Article 8 of the ECHR is central: the tribunal weighs the public interest in immigration control against the impact on your private and family life. If the First-tier Tribunal dismisses your appeal, you may be able to appeal to the Upper Tribunal, but only on a point of law — you must demonstrate that the First-tier judge made a legal error, not simply that you disagree with the factual findings. Permission to appeal must be sought within 14 days of the First-tier decision. Beyond the tribunal system, judicial review is available as a last resort — a High Court challenge to the lawfulness of a decision, available where the Home Office acted procedurally unfairly, irrationally, or in breach of its own policies. Judicial review must be issued promptly, and in any event within three months. Deadlines across all challenge routes are strict and missing them is almost always fatal. Can I appeal any visa refusal?
No — not all visa refusals carry a right of appeal. You have a right of appeal to the First-tier Tribunal where the refusal engages human rights (typically Article 8 — family and private life), protection (asylum and humanitarian protection), and EEA/EUSS rights. Work visa, student visa and visit visa refusals generally carry no appeal right — only administrative review. What is administrative review and when should I use it?
Administrative review is a paper-based reconsideration of the original decision by a different Home Office caseworker. What happens at an immigration tribunal hearing?
A First-tier Tribunal hearing is an oral hearing before an immigration judge. The Home Office will be represented by a Presenting Officer who will argue that the refusal was correct. Your solicitor or barrister will present your case, call witnesses, submit evidence and make legal arguments. You may be called to give evidence and be cross-examined. The judge will consider all the evidence — including new evidence not available at the time of the original decision — and make a fresh decision. What is judicial review in immigration cases?
Judicial review is a High Court challenge to the lawfulness of a decision by a public body — in this case the Home Office. It is typically used where there is no other remedy available — for example, where administrative review has failed or where the decision is so unreasonable that no reasonable decision-maker could have reached it.
