What is a military freezing cold injury?
A freezing cold injury, commonly known as frostbite, occurs when body tissue actually freezes due to exposure to sub-zero temperatures. Ice crystals form within the cells, causing direct cellular damage and disruption to blood flow, most commonly affecting the fingers, toes, ears, and nose.
Frostbite is classified into four grades of severity. Grade 1 involves superficial freezing with numbness and redness. Grade 2 produces blistering and partial-thickness skin damage. Grade 3 extends into deeper tissue layers with blood-filled blisters and significant tissue death. Grade 4, the most severe, involves full-thickness freezing that extends to muscle, tendon, and bone, and frequently results in the need for surgical amputation. Even lower-grade frostbite can cause lasting cold sensitivity, chronic pain, and permanent changes to the affected tissue.
The Ministry of Defence owes a duty of care to all service personnel to provide adequate cold weather protection, implement warming protocols, monitor environmental conditions, and evacuate individuals showing early signs of cold injury. When the MoD fails in any of these duties and a service member suffers frostbite as a result, that individual has a right to pursue a civil compensation claim with our military injury solicitors. NFCI vs Frostbite: Both Are Compensable
It is important to understand the distinction between non-freezing cold injury and frostbite, as they are different medical conditions with different mechanisms of injury, although both arise from inadequate cold weather protection during military service. NFCI is caused by prolonged exposure to cold and wet conditions above freezing, damaging the peripheral nerves gradually over hours or days. Frostbite, by contrast, occurs when tissue actually freezes at sub-zero temperatures, causing direct cellular damage through ice crystal formation. Both conditions can produce permanent, life-changing symptoms including chronic pain, cold sensitivity, and loss of function.

What is the time limit for making a military frostbite claim?

However, there are important exceptions: for example, if you were under 18 at the time, the limitation period does not begin until your 18th birthday. In cases where the full extent of the damage only became apparent later, the date of knowledge may be extended.
