Two routes to compensation
The AFCS is the MoD's no-fault tariff system with capped awards. A civil claim is fault-based and uncapped, consistently delivering substantially higher compensation that reflects your actual losses.

Under the Armed Forces Compensation Scheme, a service member with moderate NFCI affecting both feet would typically receive a tariff award of around £25,000. This is a fixed amount determined by the severity table and takes no account of the individual's personal circumstances, lost earnings, or future needs. How much does the AFCS typically pay out?
AFCS awards are based on a tariff system with 15 levels. The lowest tariff (level 15) pays £1,236 for minor injuries, while the highest (level 1) pays £650,000 for the most catastrophic injuries. Most claims fall in the middle range, with awards typically between £5,000 and £50,000. The scheme also includes a Guaranteed Income Payment (GIP) for more serious injuries, providing a regular income. However, the AFCS does not compensate for lost earnings, future care costs, or the full impact on your quality of life, which is why a civil claim often delivers substantially more.
How much more does a civil claim typically pay compared to the AFCS?
Civil claims consistently deliver significantly higher compensation than the AFCS because they are individually calculated to reflect your actual losses. As a general guide, civil awards are often three to five times higher than the equivalent AFCS tariff, and in cases involving substantial lost earnings or future care needs, the difference can be even greater. For example, a moderate NFCI case might attract an AFCS award of £25,000 but a civil claim of £120,000 or more. The exact difference depends on the severity of your injury and its impact on your earning capacity and quality of life.
Do I need a solicitor for an AFCS claim?
You are not legally required to use a solicitor for an AFCS application, and many service personnel submit their claims directly to Veterans UK. Many AFCS applications are initially awarded at too low a tariff, requiring an appeal. I have already accepted an AFCS payment — can I still bring a civil claim?

The only practical effect is that your AFCS lump sum will be offset against any civil award to prevent double recovery.
