In serious military injury cases, special damages frequently represent the largest component of the total compensation award. While general damages for pain and suffering are assessed within established bracket ranges, special damages are calculated individually and have no upper limit. They reflect the actual financial impact of your injury on your life, and in cases involving career-ending injuries to young service personnel, the figures can be very substantial indeed.
Consider a soldier aged 25 who suffers a career-ending injury and is medically discharged. If that individual would have served until age 55 and then drawn a full military pension, the lost earnings alone could exceed five hundred thousand pounds before pension loss, care costs, and other heads of damage are even considered. When you add the loss of a military pension, the cost of future medical treatment and rehabilitation, and the need for care and assistance, the total special damages claim can run into seven figures. What are special damages and what do they cover?

Compensation is calculated by combining general damages for pain and suffering with special damages for financial losses. General damages are assessed using the Judicial College Guidelines, which provide bracket ranges based on the type and severity of your injury. Special damages are calculated individually using evidence from medical experts, forensic accountants, and care specialists. How long does it take to receive compensation?

Interim payments are deducted from the final settlement amount, so they do not reduce the total compensation you receive. What happens if my condition worsens after my claim has settled?
Once a compensation claim is settled, it is generally final and cannot be reopened.
