The Defence Medical Services provides healthcare to all serving personnel, and the legal standard of care is exactly the same as the NHS. When military doctors fail to diagnose, make surgical errors, or delay treatment, the MoD is fully liable.
Military medical negligence can take many forms. Post-deployment screening failures represent another significant area of military medical negligence. The MoD is required to conduct thorough medical assessments of personnel returning from operational deployments to identify both physical and psychological injuries. When these screenings are rushed, superficial, or not conducted at all, conditions go undetected, sometimes for years. Accessing Your Military Medical Records
Military medical records are the foundation of any medical negligence claim against the MoD. These records document your consultations, diagnoses, treatments, referrals, and any complaints you made about your care. Under the Data Protection Act 2018 and the UK GDPR, you have a legal right to access your military medical records through a Subject Access Request (SAR). This right applies to both serving personnel and veterans, and the MoD must respond within one calendar month of receiving your request.
The SAR process for military medical records can be more complex than obtaining NHS records. Your records may be held across multiple systems — including the Defence Medical Information Capability Programme (DMICP), paper records from field deployments, and records held by the Veterans UK Medical Records department. Can I claim against military doctors for medical negligence?
Yes, military doctors are held to the same professional standards as NHS doctors, and the MoD is vicariously liable for the negligent acts of its medical staff. If a military doctor, nurse, medic, or other healthcare professional provided care that fell below the standard you were entitled to expect, and this caused you harm, you have a legal right to bring a compensation claim against the Ministry of Defence. How do I get my military medical records?
You can obtain your military medical records by making a Subject Access Request (SAR) under the Data Protection Act 2018. What is the time limit for a military medical negligence claim?
The standard limitation period is three years from the date of the negligent treatment, or three years from the date you first became aware that your condition was caused or worsened by substandard medical care. This second point — known as the date of knowledge — is particularly important in military medical negligence cases, where the effects of poor treatment may not become apparent until months or even years later. There are exceptions that can extend the time limit, but we strongly advise seeking legal advice as early as possible to protect your position.
Is claiming against military healthcare different from claiming against the NHS?
The legal principles are the same — you must prove that the care fell below an acceptable standard and that this caused you harm. However, there are practical differences. Military medical records are held on different systems and can be harder to obtain. The operational context in which military medical care is provided — particularly in field hospitals and on deployments — adds complexity. Additionally, the MoD is the defendant rather than an NHS Trust, which affects how the claim is processed.
