How no win no fee works
A Conditional Fee Agreement (CFA) means Abraham Baron Solicitors take on your military injury claim with no upfront payment. If your claim is unsuccessful, you pay nothing whatsoever.
If your claim succeeds, a success fee is deducted from your compensation. This fee is capped by law at a maximum of 25% of the damages awarded for pain, suffering, and loss of amenity. The cap exists to protect claimants and ensure that the majority of your compensation always remains with you. We explain the exact terms clearly and in writing before you sign anything.
To further protect you against financial risk, we arrange After-the-Event (ATE) insurance at no upfront cost. This insurance covers the other side's legal costs and any disbursements in the event that your claim does not succeed. The ATE premium is only payable if your claim wins, and it is typically recoverable from the losing party. From start to finish, there is genuinely zero financial risk to you.

What does no win no fee actually mean?
No win, no fee means that you do not pay any legal fees unless your claim is successful. If Abraham Baron Solicitors take on your military injury claim under a Conditional Fee Agreement and your claim does not succeed, you owe us nothing at all. There are no upfront payments, no hourly rates, and no hidden charges. The entire financial risk of pursuing your claim is borne by us, not by you. This arrangement ensures that every injured service member can access specialist legal representation regardless of their financial circumstances.
How much is the success fee if I win?
The success fee is capped by law at a maximum of 25% of the damages awarded for pain, suffering, and loss of amenity. It does not apply to other heads of damage such as past and future loss of earnings, care costs, or other special damages. The exact percentage will be agreed with you in writing before you sign the Conditional Fee Agreement, and we will explain precisely what this means in terms of the compensation you will receive. Abraham Baron Solicitors are committed to full transparency on all fee arrangements.
What is After-the-Event insurance and do I need it?
After-the-Event (ATE) insurance is a policy that protects you against the other side's legal costs and any disbursements if your claim is unsuccessful. We arrange ATE insurance for all no win, no fee clients at no upfront cost. The premium is only payable if your claim succeeds, and it is typically recoverable from the Ministry of Defence as part of the settlement. ATE insurance provides a crucial additional layer of financial protection, ensuring you face genuinely zero risk at any point during your claim.
Will I owe anything if my claim fails?
No. If your claim is unsuccessful, you owe Abraham Baron Solicitors nothing for our legal fees. The ATE insurance policy covers the other side's costs and any disbursements such as medical report fees or court fees. This means that from the moment you instruct us to the conclusion of your case, there is no financial risk to you whatsoever. We bear the entire cost of investigating and pursuing your claim, and if it does not succeed, we absorb that cost entirely.
What are disbursements and who pays for them?
Disbursements are costs incurred during your claim that are paid to third parties rather than to your solicitor. They include medical expert report fees, court issue fees, barrister fees, and the cost of obtaining records. Under our no win, no fee arrangement, Abraham Baron Solicitors fund all disbursements during the course of your claim. If your claim succeeds, these costs are typically recovered from the Ministry of Defence. If your claim fails, they are covered by the ATE insurance policy.
