The 3-year rule
The Limitation Act 1980 imposes a three-year time limit on personal injury claims against the MoD. The clock runs from the date of injury or from the date you first connected your symptoms to military service.
For many service personnel, the date of knowledge is significantly later than the date of the original incident. A soldier who developed numbness in the feet during exercises in Canada may not connect the symptoms to NFCI until years later when diagnosed by a specialist. Similarly, PTSD symptoms often emerge gradually, and the connection to a specific traumatic event may only become clear through medical assessment.
Once three years have elapsed, the court's ability to allow your claim is severely limited. Evidence deteriorates over time, witnesses become harder to locate, and medical records may be lost or destroyed. What exactly is the 3-year time limit for military injury claims?
The Limitation Act 1980 requires that personal injury claims, including those against the Ministry of Defence, must be brought within three years. This period runs from the date of injury or the date you first became aware that your condition was linked to your military service. Once three years have passed from the relevant date, your right to claim is extinguished unless the court exercises its rare discretionary power to extend the deadline. What if I did not know what was causing my symptoms?

If you were under 18 when you sustained your injury, the three-year limitation period does not begin until your 18th birthday. This means you have until your 21st birthday to issue proceedings. This provision exists to protect young service personnel who may lack the maturity or awareness to seek legal advice. However, once your 18th birthday passes, the clock begins ticking, and we strongly recommend seeking advice well before your 21st birthday to allow adequate time for evidence gathering.
What happens if I miss the deadline?
If you miss the three-year deadline, your right to claim is generally lost. The court has a discretionary power under Section 33 of the Limitation Act 1980 to allow late claims in exceptional circumstances, but this power is exercised very rarely. The court considers factors including the reason for the delay, the effect on available evidence, and the prejudice to both parties. Relying on this discretion is extremely risky and uncertain. Can a court extend the time limit for military injury claims?
