Every employer in the UK has a legal duty to provide a safe working environment. When that duty is breached through negligence, inadequate training, faulty equipment, or unsafe premises, you have a right to claim compensation for your injuries.
The legal framework protecting employees in the workplace is extensive. The Health and Safety at Work Act 1974 imposes a general duty on employers to ensure, so far as is reasonably practicable, the health, safety and welfare of their employees. This is supplemented by the Management of Health and Safety at Work Regulations 1999, the Manual Handling Operations Regulations 1992, the Work at Height Regulations 2005, and the Provision and Use of Work Equipment Regulations 1998 (PUWER). These regulations create specific legal duties that go beyond general negligence — an employer who breaches a specific regulation is presumed to be negligent. Employers must carry out risk assessments, provide adequate training, maintain equipment in safe working order, and ensure safe systems of work at all times. The most common reason people hesitate to bring an accident at work claim is concern about the effect on their employment. This concern, while understandable, is unfounded. Can I be sacked for claiming against my employer?
No. It is unlawful for an employer to dismiss you or subject you to any detriment because you have brought a personal injury claim. Any dismissal connected to a claim would constitute automatic unfair dismissal under the Employment Rights Act 1996 and could give rise to a separate employment tribunal claim. Your personal injury claim is made against your employer's liability insurer, not against your employer personally — all employers are legally required to hold this insurance. What if my employer says the accident was my fault?
An employer blaming you for an accident does not end your claim. Employers often try to deflect responsibility, but the legal duty to provide a safe workplace rests with them. Even where you made an error, the question is whether your employer's negligence — inadequate training, missing safety equipment, failure to supervise — contributed to the accident. Courts regularly find employers partially or wholly liable even where the employee made a mistake, because the employer's systems should prevent foreseeable errors from causing injury. We investigate the circumstances thoroughly and gather evidence of any breach of duty.
Do I need to report my accident before making a claim?
While there is no strict legal requirement to report your accident before making a claim, doing so significantly strengthens your case. Your employer is required to maintain an accident book under the Social Security (Claims and Payments) Regulations 1979, and you have a right to record your accident in it. For serious injuries, your employer must also report the accident to the HSE under RIDDOR. A contemporaneous accident report creates an evidential record that is difficult for your employer to challenge later. How long do I have to make an accident at work claim?
The standard limitation period is three years from the date of the accident. For gradual-onset conditions such as industrial disease or repetitive strain injury, the three years runs from the date of knowledge — the date you first knew or should reasonably have known that your condition was connected to your work. Acting promptly is important because workplace evidence (CCTV, maintenance logs, risk assessments) may be lost or destroyed over time, and witnesses change jobs. What if I am self-employed — can I still claim?
Self-employed workers can claim compensation if they were injured due to another party's negligence. This may include the client who engaged you (if they controlled the working environment), the occupier of the premises, another contractor on site, or the manufacturer of faulty equipment. The analysis focuses on who owed you a duty of care and whether they breached it, rather than your employment status. Can I claim if a colleague caused the accident?
Yes. If a colleague's actions caused your injury, the claim is brought against your employer under the principle of vicarious liability — an employer is liable for the negligent acts of its employees carried out in the course of their employment. This means you do not have to claim directly against your colleague, and the claim is paid by your employer's liability insurer. Vicarious liability applies whether the colleague was following instructions, acting carelessly, or even acting in breach of their employer's rules, provided the act was sufficiently connected to their employment.
