How is personal injury compensation calculated?
Personal injury compensation in England and Wales is made up of two distinct elements: general damages (for pain, suffering and loss of amenity) and special damages (for your actual financial losses). Understanding both is essential to knowing what your claim is truly worth.
General damages compensate you for the injury itself: the pain and suffering you have experienced, the impact on your quality of life (known as loss of amenity), and the psychological effects of the accident. General damages are assessed using the Judicial College Guidelines, which provide compensation brackets for different injuries based on their type and severity. Judges and insurers use these guidelines to value the "pain and suffering" element of every personal injury claim. What are general damages in a personal injury claim?
General damages compensate you for the non-financial impact of your injury — the pain you have experienced, the suffering caused by your condition, and the loss of amenity (the impact on your quality of life, hobbies, relationships, and daily activities). The amount is assessed using the Judicial College Guidelines, which provide compensation brackets for every type of injury based on severity and prognosis. Abraham Baron Solicitors use these guidelines alongside relevant case law to argue for the highest appropriate award within the bracket for your specific injuries.
What are special damages?
Special damages cover your actual, provable financial losses resulting from the injury. This includes lost earnings (past and future), the cost of medical treatment, rehabilitation, care and assistance (including care provided by family members, which is valued even though unpaid), travel to medical appointments, aids and equipment, home adaptation, and any other out-of-pocket expense. In serious injury cases, special damages are often the largest element of the claim by far — a lifetime of lost earnings and care costs can run into millions. Abraham Baron Solicitors meticulously document and claim every head of special damage.
How are future losses calculated?
Future losses — including future lost earnings, future care costs, and future medical treatment — are calculated using a multiplier-multiplicand approach based on the Ogden Tables. The annual loss (multiplicand) is assessed by the relevant expert — an employment consultant for earnings, a care expert for care costs — and then multiplied by a factor (multiplier) that reflects the number of years the loss will continue, adjusted for contingencies and the present value of future payments. The discount rate (currently minus 0.25%) is applied to ensure the lump sum, when invested, produces income equivalent to the annual loss. Abraham Baron Solicitors instruct experienced experts and forensic accountants to ensure accurate calculations.
Does contributory negligence reduce my compensation?
Contributory negligence arises where the claimant's own conduct contributed to the accident or the severity of injuries. If established, it reduces your compensation by a percentage reflecting your share of responsibility. For example, a finding of 25% contributory negligence on a £100,000 claim would reduce the award to £75,000. Common contributory negligence arguments include failure to wear a seatbelt (typically 15-25% reduction), crossing the road outside a designated crossing, or not wearing a cycling helmet where head injuries result. Contributory negligence reduces but does not eliminate your compensation.
How long until I receive my compensation?
The timeline depends on the complexity of your case. Simple portal claims (whiplash, minor injuries) can settle in 3-6 months. Standard employer liability and public liability claims typically take 12-18 months. Serious injury claims take 2-5 years because the medical condition must stabilise before a final settlement can be agreed — settling too early risks undervaluing your claim. Interim payments can provide funds during the claim process for serious injury cases.
