The dependency is calculated based on the deceased's net income after deducting their own living expenses, projected over the period the dependant would have received support. Who can bring a fatal accident claim?
A dependency claim under the Fatal Accidents Act 1976 can be brought by the deceased's spouse or civil partner, former spouse (if receiving maintenance), cohabitant (if they lived together for at least 2 years), parents, children, and anyone treated as a child of the family. The claim is usually brought by the personal representative of the estate on behalf of all dependants, but any individual dependant can bring the claim if the estate does not act. What is the bereavement award and who receives it?
The bereavement award is a fixed statutory payment, currently £15,120 in England and Wales, intended to compensate for the grief and sorrow of losing a close family member. It is available only to the spouse or civil partner of the deceased, or to the parents of an unmarried minor child (shared equally between them). Cohabitants, adult children, siblings, and other family members are not eligible for the bereavement award, regardless of the closeness of their relationship. The bereavement award is a modest sum and is widely criticised as inadequate, but it is an automatic entitlement where the qualifying relationship exists.
What is an inquest and do I need legal representation?
An inquest is a public hearing conducted by a Coroner to establish who the deceased was, when and where they died, and how they came by their death. Inquests are investigative rather than adversarial — no one is "on trial" — but the findings can significantly affect the civil compensation claim. Interested parties (including family members, employers, and healthcare providers) can be legally represented at the inquest. Having a solicitor at the inquest ensures that the right questions are asked, relevant evidence is explored, and the findings support rather than undermine the subsequent civil claim. How long do I have to bring a fatal accident claim?
The limitation period for a dependency claim under the Fatal Accidents Act 1976 is three years from the date of death, or three years from the date of knowledge if the cause of death was not immediately apparent. For the estate claim under the Law Reform (Miscellaneous Provisions) Act 1934, the limitation period is three years from the date of death. The two claims run in parallel and are usually brought together. If the deceased had a personal injury claim that was within time at the date of death, the estate inherits that claim with its original limitation period. How is a dependency claim calculated?
A dependency claim is calculated based on the financial support the deceased would have provided to each dependant had they lived. The calculation starts with the deceased's net annual income, deducts a percentage for their own personal expenses (typically 33% for a married person with children), and then projects the resulting dependency figure over the period for which the dependant would have been financially supported. For a surviving spouse, this is typically until the deceased's projected retirement age. For children, it is typically until they complete education. The calculation also includes the value of services the deceased provided — childcare, household maintenance, DIY — which must now be replaced at commercial rates.
