What is the date of knowledge rule for industrial disease?
The date of knowledge is the date on which you first knew, or should reasonably have known, three things: that your condition was significant (not trivial), that it was attributable to your work, and that it was caused by an identifiable party's negligence. The three-year limitation period runs from this date, not from the date of exposure. For noise-induced hearing loss, this might be the date of an audiogram revealing occupational damage. For asbestosis, it might be the date of a diagnostic scan. The analysis is fact-specific and Abraham Baron Solicitors will advise you on the limitation position in your particular case.
How is industrial disease compensation calculated?
Compensation for industrial disease covers both the physical condition and its impact on your life. General damages (pain, suffering and loss of amenity) are assessed using the Judicial College Guidelines and depend on the type and severity of the disease. Special damages cover your actual financial losses including lost earnings (past and future), medical treatment costs, travel to medical appointments, care provided by family members, and aids and equipment. For conditions that reduce life expectancy, such as mesothelioma, a claim for loss of expectation of life is also included.
