Can I claim if the driver says it was my fault?
A driver blaming you for the accident does not prevent you from claiming. What is the helmet defence and can it reduce my compensation?
The helmet defence arises where an injured motorcyclist was not wearing a helmet, or wearing a non-compliant helmet, at the time of the accident. If proven, it can reduce your general damages award on the basis that you contributed to your own injuries. However, the reduction is typically limited — courts have awarded full compensation where the injuries would have occurred regardless of helmet use, and the defence does not apply to injuries unrelated to head trauma. How long do I have to make a motorcycle accident claim?

Can pillion passengers claim compensation?
Yes. A pillion passenger has the same right to claim compensation as any other road accident victim. You can claim against the driver of the vehicle that caused the accident, or against the motorcyclist if their riding was negligent. Passengers are in a strong position to claim because their own conduct is not a causative factor in the accident. We regularly represent pillion passengers in motorcycle accident claims.
What compensation can I claim for a motorcycle accident?
Compensation covers both general damages (pain, suffering and loss of amenity) and special damages (your actual financial losses).
