Conditional fee agreements
How does no win no fee work?
A no win no fee agreement — formally called a Conditional Fee Agreement (CFA) — is a funding arrangement between you and your solicitor. Under a CFA, you pay no legal fees if your claim is unsuccessful. If your claim succeeds, a success fee is deducted from your compensation.
Under a Conditional Fee Agreement, the solicitor agrees to work on your case without charging any fees during the claims process. If the claim fails, you owe nothing — the solicitor absorbs the cost of all the work done on your behalf. If the claim succeeds, the solicitor charges their standard fees (which are recovered from the defendant's insurer) plus a "success fee" that is deducted from your compensation. The success fee is capped by law at 25% of the general damages and past losses element of the compensation — it cannot be deducted from future losses. This means you always receive at least 75% of your general damages plus 100% of your future losses, including future lost earnings, future care costs, and future medical expenses.
After-the-Event (ATE) insurance is taken out after the accident to protect you against the risk of paying the defendant's costs and disbursements if your claim fails. The premium is typically deferred and only payable if the claim succeeds, in which case it is usually recoverable from the defendant or deducted from compensation. Under Qualified One-Way Costs Shifting (QOCS), personal injury claimants are generally protected from paying the defendant's costs even if they lose — making ATE insurance a secondary safeguard against disbursement costs such as medical report fees and court fees. No win no fee — myths vs reality
Myth: "Solicitors take most of the compensation."
Reality: The success fee is capped at 25% of general damages and past losses. It cannot touch future losses, future care costs, or any other element of special damages relating to the future. In serious injury cases where future losses form the largest part of the claim, the success fee represents a small fraction of the total compensation recovered. The majority of your compensation is always protected by law.
Myth: "You might have to pay costs if you lose."
Reality: Under QOCS, personal injury claimants are protected from adverse costs orders in all but the most exceptional circumstances (fraud, fundamental dishonesty). ATE insurance provides additional protection for disbursements. Abraham Baron Solicitors' clients face zero financial liability if their claim is unsuccessful. What exactly is a no win no fee agreement?
A no win no fee agreement, formally called a Conditional Fee Agreement (CFA), is a legally binding contract between you and your solicitor. It sets out that you will pay no legal fees if your claim is unsuccessful. If your claim succeeds, the agreement entitles the solicitor to charge a "success fee" which is deducted from your compensation. The success fee compensates the solicitor for the risk of taking on your case without any guaranteed payment. What is a success fee and how much is it?
The success fee is an additional amount the solicitor is entitled to charge when a no win no fee claim succeeds. Since April 2013, it has been capped at 25% of the general damages and past financial losses element of your compensation. The success fee cannot be deducted from future losses — future lost earnings, future care costs, and future medical expenses are protected. In practice, for serious injury claims where future losses are the largest element, the success fee represents a relatively small proportion of the total compensation recovered. What is ATE insurance?
After-the-Event (ATE) insurance is a policy taken out after the accident to protect you against the risk of paying certain costs if your claim fails. These costs typically include disbursements — medical report fees, court fees, expert fees — and, in limited circumstances, the defendant's costs. ATE premiums are usually deferred (you pay nothing upfront) and are only payable if the claim succeeds. Under the QOCS regime, ATE insurance is primarily a safeguard against disbursement liability. What is QOCS and does it protect me?
Qualified One-Way Costs Shifting (QOCS) is a rule that protects personal injury claimants from being ordered to pay the defendant's legal costs if they lose their claim. Before QOCS was introduced, losing a personal injury case could mean paying the defendant's legal costs — a risk that deterred many genuine claims. Under QOCS, a costs order against you can only be enforced up to the amount of any damages and interest you have received, which in an unsuccessful claim is zero. The protection can be lost in cases of fraud or fundamental dishonesty, but for genuine claimants, QOCS provides comprehensive cost protection.
What if I already have legal expenses insurance?
Many people have legal expenses insurance (BTE — before-the-event insurance) included in their car, home, or travel insurance policy without realising it. If you have BTE cover, your insurer will pay your solicitor's fees directly, which means no success fee is deducted from your compensation. However, BTE policies often have conditions — panel solicitor requirements, financial limits, and claim type restrictions — that may make them unsuitable for your case. Abraham Baron Solicitors will check your existing insurance and advise whether BTE or a CFA is the better option for you.
Can I switch solicitors if I am unhappy?
Yes. You have the right to change solicitors at any time during your claim. Under the Solicitors Regulation Authority Code of Conduct, your current solicitor must not obstruct a transfer and must hand over your file promptly. However, there may be costs implications — your current solicitor is entitled to charge for work already done, and these costs may be deducted from your eventual compensation or passed to your new solicitor.
