Can I claim if I was crossing a road not at a crossing?
Crossing a road at a point that is not a designated crossing does not necessarily mean you were at fault. Drivers must look out for pedestrians and give way where they have already committed to crossing. Courts assess what a reasonable driver should have seen and done in the circumstances. Where there is some fault on your part, contributory negligence reduces your award proportionately rather than eliminating it. What if the driver who hit me drove off?
If the driver left the scene before you could obtain their details, you can still claim compensation through the Motor Insurers Bureau (MIB) Untraced Drivers Agreement. You must report the accident to the police within 14 days and obtain a crime reference number.
