Injured in a public place?
If you have been injured in a public place due to a hazard that should have been identified and remedied, you may be entitled to compensation. The occupier or local authority responsible for the premises owes you a duty of care to keep the environment reasonably safe.
The legal framework for public liability claims is primarily governed by the Occupiers' Liability Act 1957, which imposes a duty on occupiers to take reasonable care that lawful visitors will be reasonably safe in using the premises for the purposes for which they are invited or permitted to be there. The Occupiers' Liability Act 1984 extends a more limited duty to trespassers and those using premises for purposes other than those for which permission was granted. For accidents on public highways and pavements, section 41 of the Highways Act 1980 imposes a duty on local authorities to maintain the highway in a condition that is reasonably passable for ordinary traffic. The key question in every public liability claim is whether the occupier or authority knew or should have known about the hazard and failed to take reasonable steps to prevent injury. “Should have known” is assessed against the standard expected of a reasonable occupier — including regular inspection schedules, cleaning regimes, risk assessment procedures and maintenance programmes. Photographs of the hazard — the wet floor, pothole, uneven surface, or damaged equipment — should be taken immediately if possible, showing the exact condition at the time of the accident. Report the accident to the occupier and ask for a copy of the accident report, as this creates a contemporaneous record that is difficult to dispute. Obtain the names and contact details of any witnesses who saw the accident or the hazard. CCTV footage is often available in shops, car parks and leisure centres but is typically overwritten within 14 to 30 days, making early action essential. Frequently asked questions
Can I claim for a trip on a broken pavement?
Yes. Local authorities have a duty under section 41 of the Highways Act 1980 to maintain the highway in a condition that is reasonably passable for ordinary traffic. This includes pavements and footpaths. If you tripped on a broken paving slab, raised kerb, pothole, or uneven surface, the council may be liable if they failed to inspect and maintain the pavement properly. We obtain the council's inspection records and maintenance logs to establish whether the defect should have been identified and repaired before your accident. Photograph the defect as soon as possible and report the accident to the council.
What if there was a wet floor sign?
The presence of a warning sign does not automatically defeat your claim. A warning sign is only one part of the occupier's duty — they must also take reasonable steps to clean up the hazard within a reasonable time. If a supermarket puts out a wet floor sign but leaves a spillage for an extended period without cleaning it, the sign alone does not discharge their duty of care. The question is whether the occupier took all reasonable steps in the circumstances, not merely whether they gave a warning. How do I claim against a council?
Claims against local authorities follow the same pre-action protocol as other personal injury claims but councils often defend claims robustly. We serve a formal letter of claim on the council's legal department, requesting disclosure of their inspection and maintenance records for the relevant location. Under the Highways Act, councils have a "section 58 defence" — they can avoid liability if they can prove they had a reasonable system of inspection and maintenance. We scrutinise these records carefully because councils frequently fail to meet their own inspection schedules. What if I was injured in a shop?
Shop owners and operators owe a duty of care to customers under the Occupiers' Liability Act 1957. If you were injured due to a hazard in a shop — a wet floor, a fallen product, an uneven surface, a faulty escalator — the occupier may be liable if they knew or should have known about the hazard and failed to take reasonable steps. Most retail premises have CCTV which can provide powerful evidence of both the hazard and the accident.
