Understanding personal injury time limits
The Limitation Act 1980 sets a three-year time limit for most personal injury claims in England and Wales. This is one of the most important rules in personal injury law — if you miss the deadline, you lose the right to claim, no matter how serious your injuries.
For most personal injury claims, you have three years from the date of the accident to issue court proceedings. “Issue court proceedings” means filing the claim at court, not merely instructing a solicitor or sending a letter of claim — but all the preparatory steps must be completed within this period. The three years is a hard deadline in most cases, and courts have very limited discretion to extend it. This means that even where liability is clear and injuries are severe, a claim filed one day late can be struck out. The consequences of missing the limitation deadline are absolute in the overwhelming majority of cases — the defendant raises a limitation defence, the court upholds it, and your claim is dismissed regardless of its merits. There are important exceptions to the standard three-year rule. For children, the three-year period does not start until the child's 18th birthday, giving them until age 21 to bring a claim. A parent or litigation friend can bring the claim on the child's behalf at any time before the child turns 18. For adults who lack mental capacity — for example due to a severe brain injury suffered in the accident — the limitation period is suspended for as long as the incapacity continues. If capacity is never recovered, there is effectively no time limit. For gradual-onset conditions such as industrial disease and occupational illness, the three years runs from the “date of knowledge” — the date the claimant first knew the condition was significant, work-related, and attributable to an identifiable party. For fatal accident claims, the dependants have three years from the date of death (or date of knowledge of the cause of death) to bring a claim under the Fatal Accidents Act 1976. Acting early
Why acting early matters beyond the deadline
Evidence quality deteriorates over time. CCTV is overwritten within days or weeks. Dashcam footage is lost. Witnesses forget details, move away, or become untraceable. Accident sites are repaired, modified, or rebuilt. Medical records are strongest when injuries are assessed contemporaneously with the accident. Police reports are easier to obtain promptly. All of these factors mean that an early instruction produces a stronger claim, even if the limitation deadline is years away. The difference between a claim instructed within weeks of an accident and one instructed two years later can be significant in terms of the evidence available and the prospects of success.
Early instruction also allows rehabilitation to begin sooner. What happens if I miss the 3-year deadline?
If you miss the limitation deadline, the defendant will almost certainly raise a limitation defence and the court will strike out your claim. The court has a very limited discretion under section 33 of the Limitation Act 1980 to allow a late claim to proceed, but this discretion is exercised rarely and only in exceptional circumstances. The court considers factors including the length and reasons for the delay, the effect of the delay on the evidence, and the defendant's conduct. In practice, you should treat the 3-year deadline as absolute and contact a solicitor well in advance. Abraham Baron Solicitors always ensure claims are issued within time.
When does the 3-year clock start for industrial disease?
For industrial disease and occupational illness claims, the 3-year clock starts on the "date of knowledge" — not the date of exposure or even the date symptoms first appeared. The date of knowledge is the date you first knew, or should reasonably have known, three things: that your condition was significant, that it was attributable to your work, and that it was caused by an identifiable party's negligence. This might be the date of a diagnostic test, a specialist consultation, or even the date you read information linking your condition to your work. Can children claim after their 18th birthday?
Yes. For children injured before the age of 18, the three-year limitation period does not start until their 18th birthday. This means they have until their 21st birthday to bring a claim. Before the child turns 18, a parent or litigation friend can bring the claim on their behalf at any time. It is generally advisable to bring a child's claim as early as possible because evidence is fresher and earlier instruction allows rehabilitation to begin sooner. What if I did not know who caused my injury?
The date of knowledge rule takes account of situations where the identity of the responsible party is not immediately known. The three years runs from the date you first knew or should reasonably have known who was responsible for your injury, not necessarily from the date of the accident itself. In hit-and-run cases, for example, the limitation period may be extended if the driver's identity was unknown. However, MIB (Motor Insurers' Bureau) claims for untraced drivers have their own strict deadlines. Can the court extend the time limit?
The court has discretion under section 33 of the Limitation Act 1980 to disapply the three-year time limit where it considers it equitable to do so. However, this discretion is exercised very sparingly. The court considers the length and reasons for the delay, the cogency of the evidence, the conduct of the defendant, the extent to which the claimant acted promptly once they knew they had a claim, and the steps taken by the claimant to obtain legal advice. Successful section 33 applications are uncommon and you should never rely on the court extending the deadline. Instruct a solicitor as soon as possible.
Does the time limit apply if the other side has already admitted liability?
Yes. An admission of liability does not stop the limitation clock. Even where the defendant or their insurer has accepted fault, you must still issue court proceedings within the three-year period if the claim has not settled by that point. Insurers sometimes delay settlement negotiations deliberately, knowing that if the claimant misses the deadline, the claim will be struck out regardless of liability.
