What is a whiplash injury and can you claim?
Whiplash is a soft tissue injury to the neck and upper back caused by the sudden acceleration-deceleration force experienced in a road traffic collision. It is the single most common injury claimed for in UK road accident cases.
Whiplash injuries are graded from 1 to 4, with grade 1 being minor neck pain and stiffness and grade 4 involving severe neurological symptoms. Common symptoms include neck pain and stiffness, headaches, shoulder pain, limited range of motion, sleep disturbance, and cognitive difficulty such as problems with concentration and memory. The 2021 whiplash reforms, introduced under the Civil Liability Act 2018, created the Official Injury Claim (OIC) portal for RTA-related soft tissue injuries valued at up to £5,000. The portal applies fixed tariff amounts based on the duration of symptoms. For injuries lasting less than three months, no medical evidence is required within the portal. The reforms were designed to reduce low-value whiplash claims but have not eliminated the right to claim — they have changed how claims are valued and processed.
Importantly, many whiplash claims can be pursued outside the OIC portal. Where there are mixed injuries — whiplash accompanied by other physical injuries such as a knee injury, shoulder injury, or back injury that is not soft tissue — the claim exits the portal and is valued at common law, which is typically worth significantly more. Where psychological injuries accompany the physical whiplash, such as anxiety, PTSD, or travel phobia, these are valued separately and added to the tariff or valued outside the portal entirely. Where whiplash is severe, at grade 3 or 4 with neurological symptoms, the injury exceeds the portal threshold. Has the 2021 whiplash reform changed my right to claim?
The 2021 reforms did not remove your right to claim for whiplash — they changed how certain claims are valued and processed. For RTA-related soft tissue injuries valued at up to £5,000, claims are now made through the Official Injury Claim (OIC) portal at fixed tariff rates. However, many whiplash claims fall outside the portal — where injuries are mixed (whiplash plus other injuries), where psychological injuries are present, or where the whiplash is severe. What is the Official Injury Claim portal?
The OIC portal is a government-run online system for making RTA-related personal injury claims valued at up to £5,000. It was introduced in May 2021 as part of the whiplash reforms. Claimants can use the portal without a solicitor, but many choose to instruct one because the process involves medical evidence, legal arguments about liability and quantum, and negotiation with insurers who have significant legal teams. How much is my whiplash claim worth?
The value depends on the severity and duration of your symptoms, whether you have additional injuries, and your financial losses. Pure whiplash within the OIC portal is valued at fixed tariff rates from £240 (under 3 months) to £4,215 (18-24 months). However, if you have any non-soft-tissue injury alongside the whiplash — a fractured bone, a knee injury, a shoulder injury, psychological symptoms — your claim exits the portal and is valued at common law, often at substantially higher figures. How long do I have to claim for whiplash?
The standard limitation period of three years from the date of the accident applies to whiplash claims.
